Intellectual Property & Copyright Policy

1. Overview
This policy explains how intellectual property works on the DockSpare Platform: what's ours, what's yours, and what to do if you believe your rights — or someone else's — have been infringed. It expands on Section 8 of our Terms of Service.
2. DockSpare's Intellectual Property
The DockSpare name, logo, and the platform's software, design, and underlying code are the property of DockSpare and may not be copied, reverse-engineered, or used (including for a competing product) without our prior written consent.
3. Your Content
You retain ownership of the content you submit — product photos, listing text, offer documents, messages, and reviews. By submitting it, you grant DockSpare a non-exclusive, worldwide, royalty-free license to host, display, and distribute it as necessary to operate the Platform (for example, showing a Supplier's product photo to a Yacht User browsing the marketplace). You confirm you have the rights necessary to grant this license for everything you upload.
4. Respecting Third-Party Rights
You agree not to upload or share content through the Platform that infringes someone else's copyright, trademark, or other intellectual property rights — for example, a manufacturer's product photography used without permission, or a counterfeit part represented as genuine. This is also a violation of our Acceptable Use Policy.
5. Reporting Infringement
If you believe content on DockSpare infringes your intellectual property rights, send a notice to the contact below including:
- Identification of the work you claim is infringed;
- The specific URL or location of the allegedly infringing content on the Platform;
- Your contact information;
- A statement that you have a good-faith belief the use is not authorized;
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf;
- Your physical or electronic signature.
We will review valid notices and may remove or disable access to the reported content.
6. Counter-Notice
If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notice with your contact information, identification of the removed content, and a statement under penalty of perjury that you have a good-faith belief the content was removed in error. We may reinstate the content after a reasonable waiting period unless the original complainant informs us they've filed a legal action.
7. Repeat Infringers
We may suspend or terminate the account of a user who is the subject of repeated, valid infringement notices, consistent with the enforcement approach described in our Acceptable Use Policy.
