Buyer Terms

1. Overview
These Buyer Terms apply to any account registered as a Yacht User on DockSpare. They set out the rules specific to sourcing supplies through the Platform and incorporate the Yacht-User-facing parts of our Marketplace Liability Terms. They form part of, and should be read together with, our Terms of Service, our Acceptable Use Policy, and (once relevant to you) our Subscription & Billing Terms. If anything here conflicts with the Terms of Service, the Terms of Service control.
2. Eligibility to Buy
Your account is placed in a pending-verification state and cannot send RFQs or place Orders until DockSpare reviews and verifies it. We may decline to verify, or later revoke verification from, an account we believe misrepresents the vessel or person behind it.
3. Your Vessel & Account Details
You are responsible for the accuracy of your vessel and account details — name, home port, flag registry, and IMO number where provided. An IMO number cannot be edited once set; make sure it's correct before saving it. Accurate vessel and delivery information isn't just good practice — it's what lets a Supplier actually fulfil your Order at the right place and time.
4. RFQs & Orders
An RFQ (Request for Quote) sends your request to one or more Suppliers at once, up to your tier's per-RFQ Supplier cap; an Order is a direct request to a single Supplier. Only send an RFQ or place an Order you genuinely intend to follow through on, consistent with our Community Guidelines — a Supplier prepares a real quote or fulfilment in response, and speculative requests waste their time.
5. No Guarantee of Supplier Conduct or Quality
DockSpare does not control, and makes no representation or warranty regarding, the quality, safety, legality, or fitness for purpose of any goods or services listed, a Supplier's ability to fulfil an Order, or the accuracy of a Supplier's stated capabilities, certifications, or stock. A Supplier's account-verification status and any "Verified" badge on their storefront confirm only that DockSpare completed a basic check on the business details provided — neither is a certification of their goods, services, or reliability. You are responsible for your own due diligence (references, certifications, insurance) before entering into a transaction, especially for higher-value or safety-critical supplies.
6. Pricing, Quotes & Payment
Prices and quotes are set by Suppliers, not DockSpare, and DockSpare does not verify their accuracy or guarantee a Supplier will honor a quoted price. Payment for any Order is arranged directly between you and the Supplier — DockSpare does not process, hold, or guarantee payment for any transaction. Agree payment terms you're comfortable with before goods or services are exchanged.
7. Delivery & Fulfilment Risk
Delivery logistics, timing, and berth or port access are arranged directly between you and the Supplier using the delivery details you provide on the Order or RFQ. DockSpare is not responsible for delayed, incomplete, damaged, or failed deliveries. If your plans change (different port, different date), let the Supplier know as early as you can.
8. Crew Accounts
You may invite crew (captain, purser, engineer, and others) to share access to your vessel's account, up to your tier's team-seat limit. Only the account Owner may edit the vessel profile, send or cancel crew invites, or remove a crew Member; a Member has the same day-to-day access as the Owner to Orders, RFQs, and messaging. All crew sharing one vessel account can see that vessel's Orders and RFQs. See our Help Center for how to manage crew access.
9. Subscription Tier & Usage Limits
Your tier determines your monthly RFQ allowance and how many Suppliers a single RFQ can reach. See our Subscription & Billing Terms for how tiers, limits, and billing work.
10. Disputes With Suppliers
Any dispute over the quality, timeliness, pricing, or fulfilment of an Order is between you and the Supplier involved. DockSpare has no obligation to mediate or arbitrate such disputes, though we may, at our sole discretion, use information available on the Platform (such as order message history) to help both sides resolve it.
11. Insurance
DockSpare does not provide insurance covering goods, services, or deliveries you receive through the Platform. You are responsible for maintaining insurance appropriate to your vessel's operations.
12. Indemnification
You agree to indemnify DockSpare against any claim brought by a Supplier or third party arising from your conduct on the Platform, including any transaction you entered into through it.
13. Force Majeure
Neither DockSpare nor any Yacht User is responsible for delay or failure to perform caused by events beyond reasonable control, including severe weather, port closures, customs delays, or strikes.
14. Suspension & Termination
We may suspend or terminate your account for violating these Buyer Terms, our Terms of Service, or our Acceptable Use Policy, consistent with the enforcement approach described in those documents.
15. Governing Law
These Buyer Terms are governed by the laws of Malta, consistent with our Terms of Service, and form part of the agreement between you and DockSpare.
